Obviously its not the aesthetic ideal - but its not unusual. It could be caused by difference in the gumline, or a mandibular can't (jaw not perfectly horizontal), or one tooth more erupted than the other. It sounds to me like you would have a difficult case as from what you wrote you can't necessarily attribute the cause of your other dental problems to your orthodontist. He can easily blame poor hygiene on your part as to the cause of your teeth continually becoming infected.

This is completely normal. They have to move teeth into weird positions in the process of putting them in their final position. It isn't as easy as just lining the teeth up in one shot.

Hard to tell if surgery is needed b/c we can't see your molar relationship.

If you are referring to the canines on the bottom arch - I think its a lot harder to intrude those teeth because of the anatomy of the lower jaw.
